KEW GARDENS, NY – A former New York City firefighter appeared in court on charges related to a fatal car crash that claimed the life of a young man. Michael Pena is facing charges of manslaughter and driving while intoxicated after a tragic incident on February 26 left 23-year-old Justin Diaz dead.
In an emotional scene, nearly two dozen family members of the victim, Justin Diaz, gathered outside the courthouse demanding justice. They held photos of Diaz, who was only a block and a half away from his family’s home when his life was cut short. The family shared the heartbreaking detail that Diaz’s college degree from Vaughn College arrived in the mail just days after his death.
Pena, who was off-duty at the time of the crash, is accused of speeding and running a red light while under the influence of alcohol and drugs. According to the Queens District Attorney, Pena’s vehicle collided with Diaz’s BMW on Northern Boulevard near 107th Street. The impact of the crash was devastating, and Pena was reportedly traveling at three times the speed limit.
The Fire Department of New York (FDNY) terminated Pena following a 28-day suspension. The department expressed its commitment to upholding the highest standards and stated that Pena’s actions did not reflect the values of the FDNY.
Diaz, who worked at LaGuardia Airport, had a deep passion for aviation and mechanics. His family described him as a hardworking young man who saved diligently to purchase the BMW he loved. His untimely death has left a profound void in the lives of his loved ones.
“My son’s life mattered just like anybody else’s,” said Diaz’s mother, her voice filled with sorrow. “He was an innocent 23-year-old going to work. It’s very, very sad. My heart is broken forever.”
The ongoing investigation seeks to uncover more details about the night of the crash. As the legal proceedings continue, the Diaz family remains steadfast in their pursuit of justice.
The arraignment of Michael Pena marks a significant step in the legal process, with the indictment now unsealed. Further proceedings will determine the course of justice for the family of Justin Diaz, who continue to mourn the loss of a cherished son and brother.
