MERRITT ISLAND, Fla. — A motion to halt the execution of Bryan Jennings has been filed by his attorney following the issuance of a death warrant by Gov. Ron DeSantis. Jennings, 66, was convicted in 1979 for the horrific kidnapping, rape, and murder of 6-year-old Rebecca Kunash.
State Attorney Will Scheiner, representing the 18th Judicial Circuit, expressed the long road to justice for Kunash, stating, “We’re 46 years post-offense date and still trying to achieve justice for little Rebecca.” He highlighted the turbulent history of the death penalty in Florida, noting significant rule changes that have impacted both pending and previously sentenced cases. Rule adjustments have evolved from requiring a unanimous jury decision to a simple majority, contributing to substantial delays in the justice process.
After several appeals, Jennings was tried on three occasions, with juries unanimously recommending the death penalty each time. Under Florida law, those convicted of serious crimes are afforded specific legal protections, including automatic appeals and reviews by the Florida Supreme Court, which typically occur once a conviction is finalized.
At the time of the crime, Jennings was a 20-year-old on leave from the Marine Corps, living with his mother. According to court records, he initially visited Kunash’s home and returned later that night to abduct her. The details of the case are particularly harrowing. Jennings allegedly entered Rebecca’s bedroom while she slept, covering her mouth before taking her to his vehicle. Reports indicate that he assaulted her in a remote area near the Girard Street Canal, ultimately causing her death.
Scheiner described the circumstances surrounding the case as “horrible,” underscoring the emotional toll it has had on both the victim’s family and the community. “Mr. Jennings — this has been a long time coming for him, and the family deserves this finality. I hope it happens,” he said, acknowledging the drawn-out nature of the legal proceedings.
Jennings’ execution is set for Nov. 13. Recent filings by his defense team aim once again to overturn his sentence, prompting expectations for hearings on these motions in the near future. The tragedy of Rebecca Kunash continues to resonate, especially given that her father has passed away and her mother has since relocated from Brevard County. As the legal battle continues, many await the resolution of this decades-old case.
