Man charged in cyclist’s death years after sucker punch

BROOKLYN, NY – A tragic incident from 2017 has resurfaced as a man has been charged in connection with the death of a cyclist who succumbed to his injuries after being in a coma for several years. Gary Anderson, 34, was arrested and charged with first and second-degree manslaughter as well as criminally negligent homicide, following the death of 38-year-old Diego Tapia.

The incident occurred in June 2017, when Tapia was riding his bicycle on Fulton Street in the Bedford-Stuyvesant neighborhood of Brooklyn. While riding, he was unexpectedly punched, causing him to fall and sustain severe head injuries. The attack left him in a coma, and despite hopes for recovery, he passed away in March of the previous year.

A vigil held for Tapia shortly after the incident in 2017 saw his wife and two young sons gather in prayer, clinging to hope for his recovery. However, the family’s worst fears were realized when Tapia died due to his injuries.

Anderson had previously pleaded guilty to assault in 2019 concerning the attack and was sentenced to three years in prison. The plea agreement included provisions for additional charges if Tapia’s condition worsened. With Tapia’s death, these new charges have now been brought forward.

The Brooklyn District Attorney’s office emphasized that the plea agreement was made with the understanding that further legal actions could be pursued if the victim’s health deteriorated. Anderson’s current charges could result in a prison sentence ranging from five to 15 years if he is convicted.
