WHARTON COUNTY, Texas – A mother from Wharton County, Texas, has been sentenced to 45 years in prison for the murder of her 2-year-old son. Daniel Escamia suffered from severe head trauma and numerous injuries all over his body when he passed away in May 2022, according to the Wharton County Sheriff’s Office.
His mother, Rebecca Lynn Hart, initially faced capital murder charges. However, she pleaded guilty to murder and waived her right to appeal before being sentenced to 45 years in prison. Daniel’s great-aunt, Judy Ocanas, expressed dissatisfaction with the sentence, stating, “I don’t feel that’s enough. I really don’t feel that’s enough. As much pain as he (Daniel) received from her, that’s not enough.”
Ocanas, who cared for Daniel for five months before he turned one, voiced her love for the young boy. The Texas Department of Family and Protective Services’ child fatality report revealed continuous physical abuse endured by Daniel. On the day of his death, investigators found unexplained injuries all over his body, and he had been deprived of food, forced to sleep in a closet in his filthy home near El Campo.
Hart’s sentence, while significant, sparked mixed reactions from the community. Ocanas believes Hart got off easy, stressing, “They should have had a trial. Daniel deserves a trial. I wanted life without parole.” However, Wharton County First Assistant District Attorney Mark Racer defended the decision, stating, “It’s not a perfect system, but I think we got a very just result in this case. She’s going to spend a significant amount of time in prison.”
Hart will be eligible for parole in 22.5 years, while Daniel’s father, Eddie Escamia, faces charges of endangerment of a child with bodily injury. The case against him is still pending. This tragic case sheds light on the importance of protecting vulnerable children and holding individuals accountable for such heinous actions.
