New York State to Release Body-Cam Footage Following Fatal Incident at Marcy Correctional Facility

Marcy, N.Y. — The Attorney General’s office of New York is set to release distressing body camera footage from a deadly confrontation at Marcy Correctional Facility, involving correction officers and an inmate who later died. The incident, which occurred earlier this month, led Governor Kathy Hochul to direct the ouster of 14 correctional staff implicated in the attack.

Robert Brooks, 43, lost his life on December 10 following a violent altercation while detained at the medium-security facility in Oneida County. Brooks had been serving a 12-year sentence related to a 2016 stabbing incident involving his girlfriend.

In a statement, Attorney General Letitia James expressed her commitment to uphold transparency and accountability, especially amongst law enforcement professionals. “New Yorkers deserve the highest standard of accountability,” James said. The video release is a voluntary action by James’ office, despite no state requirement mandating its disclosure.

The release is coming amid concerns about potential public outrage due to the graphic nature of the footage. State lawmakers have pre-emptively visited the facility, anticipating sensitive reactions from the community and further discussions about the conditions and practices within state correctional facilities.

The exact cause of Brooks’ death has yet to be declared by coroners. State legislation stipulates obligatory investigations by the Attorney General’s office into any civilian deaths that occur during interactions with law enforcement officers, irrespective of the officers’ duty status or the deceased’s armament.

The New York State Correctional Officers & Police Benevolent Association (NYSCOPBA) commented on the seriousness of the incident, which stands in stark contrast to the professional standards they uphold.
