Teen Receives Community Sentence for ‘Sickening’ Train Assault Amidst Disturbing Footage and Group Apathy

DUMBARTON, Scotland — A teenager received a community service sentence after a violent assault on a fellow passenger aboard a train in May 2023. The assault, which has been described as “sickening” by the presiding judge, involved serious physical harm to the victim, all captured on CCTV footage.

Brooke Hepburn, who was 16 at the time of the incident, has since turned 18 and appeared before the Dumbarton Sheriff Court to face the consequences of her actions. During the incident, Hepburn was part of a large group of young people who boarded the train at Balloch after a day of drinking. While many in the group witnessed the assault, some chose to record the event instead of intervening.

Hepburn entered a guilty plea to a charge of serious assault, acknowledging her role in repeatedly punching and kicking the victim. Evidence presented in court showed she not only struck her with fists but also dragged her by the hair and stamped on her head, resulting in the victim losing consciousness.

The court viewed video footage from the train, which depicted the moment of the assault. Sheriff Hendry expressed his shock at the attack and the behavior displayed by bystanders, questioning the moral character of those who chose to film rather than help.

Hepburn’s defense attorney described the incident as “disgusting” and stated that his client has taken full responsibility for her actions. He explained that the altercation escalated from a verbal disagreement prior to boarding the train. The attorney also highlighted that Hepburn, who has no prior criminal record, has shown remorse and has been focused on her family responsibilities, aspiring to pursue a career in health and beauty.

Despite the severity of the assault, the court determined that repeated lockdowns and community service could serve as an effective punishment. Although the crime could have warranted a custodial sentence, Hepburn’s lack of a history of offending and her subsequent good behavior influenced the judge’s decision.

Sheriff Hendry remarked that the case was serious enough to potentially warrant time in prison. He stated the level of violence approached categories considered among the most serious, including murder and attempted murder. Ultimately, he opted for an 18-month community payback order under the supervision of social services, alongside a requirement to complete 175 hours of unpaid community work over the next year.

Hepburn will also be under a curfew for six months, restricted to her home during the night. The sheriff emphasized that any breach of these conditions would likely lead to imprisonment. When asked if she understood the terms of her sentence, Hepburn quietly affirmed her comprehension.
